Welcome to Opalnirvana. These Terms and Conditions (“Terms”) govern your use of opalnirvana.com (the “Website”) and any purchase you make through it. Please read them carefully. By using the Website or placing an order, you agree to these Terms.

If you do not agree with these Terms, please do not use the Website.

Professional Buyer: A licensed healthcare professional or registered healthcare business whose license has been verified by us.
Consumer: An individual buying for purposes outside their trade, business, or profession.
Professional Products: Products intended only for use by licensed healthcare professionals, including botulinum toxins, dermal fillers, collagen stimulators, skin boosters, lipolytics, injectable anesthetics, and similar products.
General Products: Cosmetics, skincare, hair care, and personal care products that are not Professional Products.
Order: A request to buy products through the Website.

3. Eligibility

You must be at least 18 years old to use the Website and place orders.

Professional Products are sold exclusively to licensed healthcare professionals and registered healthcare businesses. By ordering Professional Products, you confirm that:

You hold a valid, current license or registration that permits you to buy, handle, and administer these products in your country.
The products will be used only by trained, qualified professionals, in line with the manufacturer’s instructions and applicable law.
You will not resell or supply the products to anyone who is not authorized to receive them.

If you are not a licensed healthcare professional or registered healthcare business, you must not order Professional Products.

4. License Verification

Before we process an order for Professional Products, you must provide proof of your professional license or business registration. We may also ask for additional documents, such as photo ID or proof of your clinic’s address.

We reserve the right to:

Delay an order until verification is complete.
Refuse or cancel an order if we cannot verify your credentials, or if we believe the information provided is false or incomplete.
Request updated documents at any time.

If an order is cancelled because verification failed, we will refund any amount you have paid.

5. Your Account

You may need to create an account to place orders. You are responsible for:

Providing accurate, complete, and up-to-date information.
Keeping your login details confidential.
All activity that takes place under your account.

Please tell us immediately if you suspect unauthorized use of your account. We may suspend or close accounts that breach these Terms.

6. Products and Information

We aim to describe and display products as accurately as possible. However, product packaging, colors, and appearance may vary slightly from the images on the Website, and manufacturers may update packaging without notice.

Product information on the Website is provided for general information only. It is not medical advice and does not replace professional clinical judgment or the manufacturer’s instructions. Professional Buyers are responsible for assessing whether a product is suitable for each patient.

All products are subject to availability. If an item you ordered becomes unavailable, we will let you know and offer an alternative or a full refund for that item.

7. Prices and Payment

Prices are shown in euros (€) and include any applicable VAT unless stated otherwise.
Delivery charges, where applicable, are shown at checkout before you pay.
Payments are processed securely by third-party payment providers. We do not store your full card details.
We may change prices at any time, but changes will not affect orders already confirmed.
If a product is listed at an obviously incorrect price due to an error, we may cancel the order and refund you in full, even after it has been confirmed.

Discount codes are subject to their stated conditions, cannot be exchanged for cash, and generally cannot be combined with other offers unless stated otherwise. We may withdraw a promotion at any time.

8. Orders and Contract

Placing an order is an offer to buy. We will send you an email acknowledging your order, but this does not mean it has been accepted. A contract is formed when we confirm that your order has been accepted or has been shipped.

We may refuse or cancel an order, for example if:

The product is unavailable.
There is a pricing or description error.
We cannot verify your professional credentials.
We suspect fraud or unauthorized activity.
Delivery to your location is not possible or is legally restricted.

If we cancel an order you have paid for, we will refund you in full.

9. Shipping and Delivery

We ship from Vilnius, Lithuania, to all countries except countries in Africa.
Once your order is confirmed and any required verification is complete, delivery usually takes 3–5 business days. Delivery times are estimates and may vary by destination, customs processing, or courier delays.
You will receive a tracking number once your order ships.
Please make sure your delivery address and contact details are correct. We are not responsible for delays or losses caused by incorrect information.

Import rules and customs. Some products may be restricted or require permits in certain countries. You are responsible for making sure the products you order can be legally imported and used in your country. Any customs duties, import taxes, or fees charged by your country are your responsibility. We are not responsible for shipments held, returned, or destroyed by customs because of local restrictions.

Risk and ownership. Risk of loss or damage passes to you when the order is delivered to you or the Recipient you named. Ownership passes to you once we have received full payment.

10. Returns and Refunds

Returns and refunds are handled under our Refund and Returns Policy, which forms part of these Terms.

In summary:

Professional Products cannot be returned once they have been shipped, for safety and product-integrity reasons, unless they arrive damaged, faulty, or incorrect.
General Products bought by Consumers may be returned in line with the Refund and Returns Policy and your statutory rights.
If an order arrives damaged, faulty, or incorrect, please contact us as soon as possible, with photos, so we can resolve it.

Nothing in these Terms affects your statutory rights as a Consumer.

11. Storage, Handling, and Use

Once products are delivered, you are responsible for storing, handling, and using them correctly, in line with the manufacturer’s instructions and applicable law, including any temperature requirements.

We are not responsible for any harm, loss, or damage resulting from:

Misuse, improper storage, or improper administration of any product.
Use by unqualified or unauthorized persons.
Use contrary to the manufacturer’s instructions or local regulations.

12. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for any indirect or consequential loss, including loss of profit, business, revenue, or goodwill.
Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.

13. Your Responsibilities

When using the Website, you agree not to:

Provide false information, including false professional credentials.
Use the Website for any unlawful or fraudulent purpose.
Resell Professional Products to unauthorized persons.
Interfere with the Website’s security or operation, or attempt to access it by automated means without our permission.

If you submit reviews, photos, or other content, you confirm that it is your own, honest, and does not infringe anyone’s rights. You give us a non-exclusive, royalty-free license to use, display, and share that content in connection with the Website and our marketing. We may remove any content at our discretion.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Lithuania. Any disputes will be handled by the courts of Lithuania.

If you are a Consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring proceedings in your local courts where the law allows.

If you have a complaint, please contact us first so we can try to resolve it. Consumers can also contact the State Consumer Rights Protection Authority of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba).

21. General

If any part of these Terms is found to be invalid, the rest remains in effect.
If we do not enforce a right immediately, we have not waived it.
You may not transfer your rights under these Terms without our consent.
